This paper reports two cases in Hong Kong involving two native Chinese adolescent cancer patients (APs) who were denied their rights to consent to necessary treatments refused by their parents, resulting in serious harm. We argue that the dynamics of the 'AP-physician-family-relationship' and the dominant role Chinese families play in medical decision-making (MDM) are best understood in terms of the tendency to hierarchy and parental authoritarianism in traditional Confucianism. This ethic has been confirmed and endorsed by various Chinese writers from (...) Mainland China and Hong Kong. Rather than giving an unqualified endorsement to this ethic, based more on cultural sentimentalism than rational moral reasoning, we warn that a strong familism in MDM, which deprives 'weak' family members of rights, represents the less desirable elements of this tradition, against which healthcare professionals working in this cultural milieu need to safeguard. Specifically for APs, we suggest that parental authority and family integrity should be re-interpreted in terms of parental responsibility and the enhancement of children's interests respectively, as done in the West. This implies that when parents refuse to consent to necessary treatment and deny their adolescent children's right to consent, doctors, as the only remaining advocates of the APs' interest, have the duty to inform the state, which can override parental refusal to enable the doctors to fulfill their professional and moral obligations. In so doing the state exercises its 'parens patriae' power to defend the defenseless in society and the integrity of the medical profession. (shrink)

Objectives: To investigate whether Chinese adolescents in Hong Kong share similar perceptions with their Western counterparts regarding their capacity for autonomous decision-making, and secondarily whether Chinese parents underestimate their adolescent children's desire and capacity for autonomous decision-making.Method:‘Healthy Adolescents’ and their parents were recruited from four local secondary schools, and ‘Sick Adolescents’ and their parents from the pediatric wards and outpatient clinics. Their perceptions of adolescents' understanding of illnesses and treatments, maturity in judgment, risk-taking, openness to divergent opinions, pressure from parents (...) and doctors, submission to parental authority and preference for autonomy in medical decision-making are surveyed by a 50-item questionnaire on a five-point Likert scale.Results: Findings indicate that Chinese adolescents aged 14–16 perceive themselves to possess the necessary cognitive abilities and maturity in judgment to be autonomous decision-makers like their Western counterparts. Paradoxically, although they hesitate to assert their autonomy, they are also unwilling to surrender that autonomy to their parents even under coercion or intimidation. Parents tend to underestimate their adolescents' preferences for making autonomous decisions and overestimate the importance of parental authority in decision-making.Conclusion:‘14-and-above’ Chinese adolescents in Hong Kong perceive themselves as capable of autonomous decision-making in medically-related matters, but hesitate to assert their autonomy, probably because of the Confucian values of parental authority and filial piety that are deeply embedded in the local culture. Carolina Sartorio has criticized the reasons-responsiveness theory of freedom for being inconsistent with the actual-sequence view motivated by the Frankfurt-style cases. Specifically, reasons-responsiveness conceived as a modal property does not pertain to the actual sequence of the agent's action and thereby it is irrelevant to the agent's freedom and moral responsibility. Call this the challenge of irrelevance. In this article, I present this challenge in a new way that overcomes certain limitations of Sartorio's argument. I argue that the root of (...) the challenge is that reasons-responsiveness as an unmanifested modal property seems to be nonexplanatory for the agent's action. I show that reasons-responsiveness theorists will confront this challenge even if they do not endorse the actual-sequence view. Finally, I deflate this challenge with David Lewis's model of causal explanation, showing that reasons-responsiveness is explanatory in virtue of providing information about the causal history of the agent's action. As a social and political thought, communitarian ideas appeared in the Pre-Qin Confucianism. By the Song Dynasty, it had become a systematic theory, namely, the learning of the “four books.” As a social and political theory, not only can Confucian communitarianism contribute to Western liberalism, but it can also be an intellectual resource for the development of democracy in East Asian countries and regions. The future of the Confucian communitarianism lies in its critique of itself and its discourse with Western (...) liberalism, by which Confucianism evolves from communitarianism into liberalism. 'Young People and Social Media: Contemporary Children's Digital Culture' explores the practices, relationships, consequences, benefits, and outcomes of children's experiences with, on, and through social media by bringing together a vast array of different ideas about childhood, youth, and young people's lives. These ideas are drawn from scholars working in a variety of disciplines, and rather than just describing the social construction of childhood or an understanding of children's lives, this collection seeks to encapsulate not only how young people exist (...) on social media but also how their physical lives are impacted by their presence on social media.One of the aims of this volume in exploring youth interaction with social media is to unpack the structuring of digital technologies in terms of how young people access the technology to use it as a means of communication, a platform for identification, and a tool for participation in their larger social world. During longstanding and continued experience in the broad field of youth and digital culture, we have come to realize that not only is the subject matter increasing in importance at an immeasurable rate, but the amount of textbooks and/or edited collections has lagged behind considerably. There is a lack of sources that fully encapsulate the canon of texts for the discipline or the rich diversity and complexity of overlapping subject areas that create the fertile ground for studying young people's lives and culture. The editors hope that this text will occupy some of that void and act as a catalyst for future interdisciplinary collections.'Young People and Social Media: Contemporary Children's Digital Culture' will appeal to undergraduate students studying Child and Youth Studies and-given the interdisciplinary nature of the collection- scholars, researchers and students at all levels working in anthropology, psychology, sociology, communication studies, cultural studies, media studies, education, and human rights, among others. Anime is exploding on the worldwide stage! Anime has been a staple in Japan for decades, strongly connected to manga. So why has anime become a worldwide sensation? A cursory explanation is the explosion of online streaming services specializing in anime, like Funimation and Crunchyroll. Even more general streaming services like Netflix and Amazon have gotten in on the game. Anime is exotic to Western eyes and culture. That is one of the reasons anime has gained worldwide popularity. This strange (...) aesthetic draws the audience in only to find it is deeper and more sophisticated than its surface appearance. Japan is an honor and shame culture. Anime provides a platform to discuss “universal” problems facing human beings. It does so in an amazing variety of ways and subgenres, and often with a sense of humor. The themes, characters, stories, plotlines, and development are often complex. This makes anime a deep well of philosophical, metaphysical, and religious ideas for analysis. International scholars are represented in this book. There is a diversity of perspectives on a diversity of anime, themes, content, and analysis. It hopes to delve deeper into the complex world of anime and demonstrate why it deserves the respect of scholars and the public alike. (shrink)

The volitional theory of human action has formed a basis for a prominent account of voluntary behavior since at least Aquinas. But in the twentieth century the notions of will and volition lost much of their popularity in both philosophy and psychology. Gilbert Ryle’s devastating attack on the concept of will, and especially the doctrine of volition, has had lingering effects evident in the widespread hostility and skepticism towards the will and volition. Since the 1970s, however, the volitional theory has (...) received some renewed interest in the philosophy of action. Two decades have passed since the first attempts were made to establish systematic ethical review of human research in the Baltic States. Legally and institutionally much has changed. In this paper we provide an historical and structural overview of ethical review of human research and identify some problems related to the role of ethical review in establishing quality research environment in these countries. Problems connected to (a) public availability of information, (b) management of conflicts of interest, (c) REC composition and (...) motivation of REC members, and (d) differing levels of stringency of ethical review for different types of studies, are identified. Recommendations are made to strengthen cooperation among the Baltic RECs. (shrink)

In “Considering Causalisms”, Andrew Sneddon critically examines causalism, the dominant position in action theory since Donald Davidson published his influential article, “Actions, Reasons, and Causes”. Sneddon’s analysis is based on a distinction he makes between two kinds of causalism. One is a minimal version of causalism, which holds only a causal view of reasons explanations. Sneddon calls it “restricted-causalism,” or causalismR.

Recall that B is PA relative to A if B computes a member of every nonempty $\Pi ^0_1(A)$ class. This two-place relation is invariant under Turing equivalence and so can be thought of as a binary relation on Turing degrees. Miller and Soskova [23] introduced the notion of a $\Pi ^0_1$ class relative to an enumeration oracle A, which they called a $\Pi ^0_1{\left \langle {A}\right \rangle }$ class. We study the induced extension of the relation B is PA relative (...) to A to enumeration oracles and hence enumeration degrees. We isolate several classes of enumeration degrees based on their behavior with respect to this relation: the PA bounded degrees, the degrees that have a universal class, the low for PA degrees, and the ${\left \langle {\text {self}\kern1pt}\right \rangle }$ -PA degrees. We study the relationship between these classes and other known classes of enumeration degrees. We also investigate a group of classes of enumeration degrees that were introduced by Kalimullin and Puzarenko [14] based on properties that are commonly studied in descriptive set theory. As part of this investigation, we give characterizations of three of their classes in terms of a special sub-collection of relativized $\Pi ^0_1$ classes—the separating classes. These three can then be seen to be direct analogues of three of our classes. We completely determine the relative position of all classes in question. (shrink)

We contribute to the empirical debate on whether we understand and predict mental states by using simulation (simulation theory) or by relying on a folk psychological theory (theory theory). To decide between these two fundamental positions, it has been argued that failure to predict other people's choices would be challenging evidence against the simulation view. We test the specific claim that people prefer the rightmost position in choosing among equally valued objects, and whether or not this position bias can be (...) correctly predicted. A series of experiments shows that the bias appears only in a specific spatial arrangement and that it can be correctly predicted given adequate imaginative input. In concert with other recent findings on the correct prediction of choices these findings do actually strengthen, rather than challenge, the simulation account on the prediction of mental states. By using the political giants and military leaders around Shanghai, business firms skillfully dealt with the difficulties of the continually changing political situation and managed to keep their businesses afloat, succeeding in their response to the consumption (...) demands of the public. It has been suggested that external and/or internal limitations paradoxically may lead to superior learning, that is, the concepts of starting small and less is more (Elman, ; Newport, ). In this paper, we explore the type of incremental ordering during training that might help learning, and what mechanism explains this facilitation. We report four artificial grammar learning experiments with human participants. In Experiments 1a and 1b we found a beneficial effect of starting small using two types of simple recursive (...) grammars: right‐branching and center‐embedding, with recursive embedded clauses in fixed positions and fixed length. This effect was replicated in Experiment 2 (N = 100). In Experiment 3 and 4, we used a more complex center‐embedded grammar with recursive loops in variable positions, producing strings of variable length. When participants were presented an incremental ordering of training stimuli, as in natural language, they were better able to generalize their knowledge of simple units to more complex units when the training input “grew” according to structural complexity, compared to when it “grew” according to string length. Overall, the results suggest that starting small confers an advantage for learning complex center‐embedded structures when the input is organized according to structural complexity. (shrink)

In their logical analysis of theorems about disjoint rays in graphs, Barnes, Shore, and the author (hereafter BGS) introduced a weak choice scheme in second-order arithmetic, called the $\Sigma ^1_1$ axiom of finite choice (hereafter finite choice). This is a special case of the $\Sigma ^1_1$ axiom of choice ( $\Sigma ^1_1\text {-}\mathsf {AC}_0$ ) introduced by Kreisel. BGS showed that $\Sigma ^1_1\text {-}\mathsf {AC}_0$ suffices for proving many of the aforementioned theorems in graph theory. While it is not known (...) if these implications reverse, BGS also showed that those theorems imply finite choice (in some cases, with additional induction assumptions). This motivated us to study the proof-theoretic strength of finite choice. Using a variant of Steel forcing with tagged trees, we show that finite choice is not provable from the $\Delta ^1_1$ -comprehension scheme (even over $\omega $ -models). We also show that finite choice is a consequence of the arithmetic Bolzano–Weierstrass theorem (introduced by Friedman and studied by Conidis), assuming $\Sigma ^1_1$ -induction. Our results were used by BGS to show that several theorems in graph theory cannot be proved using $\Delta ^1_1$ -comprehension. Our results also strengthen results of Conidis. (shrink)

This article presents the new German law on advance directives from 1 September 2009. The history of the parliamentary process of this law is described, the present regulations are explained, their relevance for medical practice discussed and shortcomings are identified. Finally, the new law is compared with other regulations in the international context. Previously established legal practice in Germany has now become largely confirmed by the new law: An advanced directive must be respected in any decision concerning medical treatment, regardless (...) of the stage of the illness. It can be informally revoked at any time, even with limited decision-making capacity. Nobody may be obliged to issue a directive in any way. Advance directives do not need notarisation or routine updating after certain time intervals. Provided that the patient, who is no longer mentally competent, has issued a lasting power of attorney, or provided that the patient has been appointed a healthcare proxy by the courts, this authorised surrogate must assert the patient's will. The role of the guardianship court is clarified: it only needs to be involved in cases of disagreement as to the patient's will. The new German law thus combines more legal certainty with a liberal emphasis on patient autonomy and flexible, adaptable regulations. (shrink)
